Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Finsense platform ("Service"), operated by Dzhukelov Solutions X EOOD ("DSX", "we", "us"), UIC 206958289, registered at Pazardzhik, 4400, Bulgaria. By accessing or using the Service, you agree to be bound by these Terms.
1. Definitions
"Service" refers to the Finsense web application, APIs, and related services. "User" or "you" refers to any individual or legal entity that creates an account or uses the Service. "Data" refers to any information, financial records, documents, or other content you upload, create, or store through the Service. "Subscription" refers to the paid or trial plan under which you access the Service.
2. Account Registration
To use the Service, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. You must be at least 18 years old and have the legal authority to enter into these Terms. You must notify us immediately of any unauthorized use of your account.
3. Service Description
Finsense provides cloud-based financial management software including, but not limited to: expense and income tracking, invoicing, payroll management, bank account management, multi-currency operations, financial reporting and analytics, budget planning, and cash flow forecasting. The specific features available depend on your Subscription plan.
4. Subscription and Payment
Paid Subscriptions are billed in advance on a monthly or annual basis, depending on the plan selected. Payments are processed securely via Stripe. All fees are exclusive of applicable taxes (VAT), which will be added where required by law. You may cancel your Subscription at any time; cancellation takes effect at the end of the current billing period. Refunds are provided only as required by applicable consumer protection laws. We reserve the right to change pricing with 30 days' advance notice.
5. Free Trial
We may offer a 14-day free trial. No credit card is required to start a trial. At the end of the trial period, you must subscribe to a paid plan to continue using the Service. We reserve the right to modify or discontinue the free trial at any time.
6. User Obligations
You agree to: (a) use the Service only for lawful purposes and in compliance with all applicable laws; (b) not attempt to gain unauthorized access to any part of the Service; (c) not use the Service to store, transmit, or process any illegal, harmful, or fraudulent content; (d) not reverse-engineer, decompile, or disassemble any part of the Service; (e) not resell, sublicense, or redistribute access to the Service without our written consent.
7. Intellectual Property
The Service, including its source code, design, logos, and documentation, is the intellectual property of DSX and is protected by copyright and other intellectual property laws. Your Subscription grants you a limited, non-exclusive, non-transferable license to use the Service. You retain all rights to your Data uploaded to the Service.
8. Data Protection
We process personal data in accordance with our Privacy Policy and the General Data Protection Regulation (EU) 2016/679 (GDPR). By using the Service, you acknowledge that you have read and understood our Privacy Policy. For business users who upload personal data of third parties (employees, clients), you act as the data controller and we act as the data processor. A Data Processing Agreement (DPA) is available upon request.
9. Service Availability and SLA
We strive to maintain 99.9% uptime for the Service. However, we do not guarantee uninterrupted availability. Scheduled maintenance will be announced at least 48 hours in advance. We are not liable for downtime caused by factors beyond our control, including force majeure events, internet service provider failures, or third-party service outages.
10. Limitation of Liability
To the maximum extent permitted by applicable law, DSX shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service. Our total aggregate liability shall not exceed the fees paid by you in the 12 months preceding the claim. Nothing in these Terms excludes or limits liability that cannot be legally excluded or limited, including liability for fraud or willful misconduct.
11. Indemnification
You agree to indemnify and hold DSX harmless from any claims, damages, losses, and expenses (including legal fees) arising from: (a) your breach of these Terms; (b) your use of the Service; (c) any Data you upload or process through the Service; (d) your violation of any applicable law or third-party rights.
12. Termination
Either party may terminate these Terms at any time. You may terminate by canceling your Subscription and closing your account. We may terminate or suspend your access immediately if you breach these Terms or if required by law. Upon termination, you have 30 days to export your Data. After this period, your Data will be permanently deleted in accordance with our data retention policy.
13. Changes to Terms
We may update these Terms from time to time. Material changes will be communicated via email or a prominent notice on the Service at least 30 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms. If you disagree with the changes, you must stop using the Service and cancel your Subscription.
14. Governing Law and Disputes
These Terms are governed by the laws of the Republic of Bulgaria. For EU consumers, mandatory consumer protection laws of your country of residence also apply. Any disputes shall be resolved by the competent courts in Pazardzhik, Bulgaria, unless mandatory EU consumer law provides otherwise. Before initiating legal proceedings, both parties agree to attempt to resolve disputes amicably within 30 days.
15. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
